  • tesco mobile, lack of network/credit agreement isssue.

    Hi there,

Have two mobile phone contracts, one for me one for my teenage son.
Sons started in Nov 14, mine in April 15. never had a really good network coverage and complained several times. Had a new sim this year and it has not improved at all.
Moved two miles away early April and i had no network coverage at all. Phone doesn't receive or send calls and text messages.
Complained again to a female Tesco customer service advisor only to be told that Tesco don't provide network coverage in my area.
Several phone calls later i was told by a manager that i could leave the contract but would have to pay £140 for the credit agreement on my sons phone and £300 for mine.
I said i was not paying this money as i had paid over £1300 on the contract and wasn't paying them any more money.
Tesco offered me £53 compensation of the outstanding penalties which i declined this increased to £106. Again i declined.
I have lost out financially as my clients have been unable to contact me and none of my friends or family can reach me.
    Now reached deadlock.

Where do i stand with the credit agreement? Am i obliged to send the phones back by recorded delivery as they are no use to me and are locked to Tesco.
    Still without a phone.

Hi Dawnie & welcome to LB.

Why do you state that it's a credit agreement?

    Are either of them B2B?

Hi there apologies for the late reply.
Re the credit agreement. That's what Tesco have said I need to pay to release me from the contract. I honestly don't know what a B2B is.

        Hi Dawnie

        B2B means business to business.

If you have moved and the area you are living in does not have much coverage then I would suggest putting in a formal complaint if you haven't done so already. Explain your situation and say that by failing to provide coverage where you are living they are in breach of contract if they refuse to cancel the contract then your only other option is to go through the small claims court against Tesco Mobile for breach of contract.

Usually if they can't provide coverage they ought to cancel the agreement. It is inherently unfair for you to keep to your side of the bargain whereas Tesco does not have to.
