    Small issue. I found out in January that I had an outstanding debt form Orange mobile that had been passed to cabots. The debt was listed six months after we moved form the property. Cabot had passed the debt to restons solicitors and I have now subsequently found out that hey have taken out a ccj. I have had no written communication from restons and this is hampering me in getting a mortgage. I feel that the easiest way is to just pay up but the principle of terminating a phone contract with the company concerned and then finding out that they haven't cancelled the contract after what is now three years.

    i have also reported this to Ofcom but they are not interested.

    If they obtained a CCJ without making any contact with you you may be able to apply to set aside the judgment and defend it ( or settle it ). Much will depend on why you didn't receive the court papers - did you inform orange or the DCA that you had moved at any point ?
