  • CCJ/Lowell help please.

    Hi, myhusband received a CCJ claim from Nottingham saying he owed Lowell £501 but with fees it would be £671. my Husband searched his credit file and under Lowell he has 3 defaults 1 he knows what it is for £191 mail order he had forgotten about as he received no correspondence to his knowledge, the second was another mail order for an address we have never lived at addressed to a dentist office? and third a mobile communications company that he has never had. We just need some advice what to do next. When my husband checked his credit file & the unknown address (dentist office) he was linked to it he contacted them to tell them and nothing has come of it to say it was a mistake or what to do next?

    Hi,

    There appear to be several different issues within the description you have given. Have you ever received a claim form for the CCJ or any correspondence relating to this?

    In regards to the defaults on your credit files, has your husband ever received a default notice in relation to any of the accounts that you have mentioned?

      That's what we have a claim form, & for the correspondence nothing about the CCJ, we have looked back and has one letter about the £191 from Lowell (mail order we know about) but nothing from the other as it is not an address were linked to so we wouldn't have got anyway, this is why we have only found out this week about,

        Did you acknowledge the claim or defend it all? If you haven't defended it or acknowledged it then that will be why Lowell have a CCJ against you. What date was the claim form issued? (The date of issue is on the top right corner of the claim form)

        In regards to the defaults that are on your husband's credit file, he should have received a default notice stating the intention to register a default on his credit file for those debts/accounts. However, you have suggested that two of three defaults on your husband's credit file relate to accounts that he has not taken out or has any knowledge of, if this is the case then it may be best to write to the companies that have registered the defaults and invite them to remove the defaults based on the fact that the accounts were not taken out by your husband, if this is the case.

          The claim form date was 20th June, we only received it Friday but have had no idea what to do with it, so haven't acknowledged or defended just yet, Lowell haven't said it was going to send to court it was just a letter ages ago saying he owed the £191 nothing else.
          This is all so confusing

            Would you perhaps be able to post a picture on here of what you have? If your claim form is dated 20th June then it most certainly should not be the case that you have a CCJ in regards to that.

            Do you have a judgment form or just the claim form?

              If you received a claim form last week then you haven't got a CCJ, just a claim. A lot of people mistakenly refer to the claim form as a CCJ but, in fact, that's still a long way away.

              You need to acknowledge service of the claim within 14 days to avoid default judgment. You can do it online using the password on your claim form. Tick the box that says you intend to defend the whole claim, that should give you another 14 days to come up with a defence and get a bit more information.

              Would be useful if you could post up the particulars of the claim as written on the form.
