hi,

i am making a payment of £40 per month towards this years bill and a contribution towards the debt. A liability order hasn't been made as far as I'm aware.

I pay towards my water bill via meter, but not towards the debts only towards this years bill.

No charges or fees have been added to my account since 2014. I'm not sure what defaulted means? I don't use the account anymore as I have a separate account for my benefits/wages to go in.

i can have a look at Noddle is it easy to use?

So sorry to hear of your ordeal.

In contract law, you cannot be forced to sign its terms under duress/ un due influence (ie forced): Barton v Armstrong [1976] AC 104. In your situation it sounds more probable than not that he manipulated you into signing things in your name as prior to his death and for some 3/ 4 years you were in an abusive relationship, ie a genuine threat/ pressure existed: Alec Lobb (Garages) Ltd v Total Oil GB Ltd [1985]. Did you say to the creditors that you signed its terms under duress/ un due influence. What type of debts are they, ie are they bank loans, are they credit card debts. Financial institutions such as banks have a special duty to ensure you have been forced into any contracts: Royal Bank of Scotland plc v Etridge (No. 2) [2001] UKHL 44. For instance if a bank's staff member (ie TSB) is present when you put the contract in your own name they have a duty to make sure you're not forced: ibid Etridge. It's not enough to ask you if your ok going ahead the bank staff member is competent to a reasonable judgement call: Etridge

In terms of evidence, in the criminal case against your dead ex, did you have a lawyer present. Was there any evidence that he put the debt in your name or did your lawyer argue that you were unduly influenced/ under duress for the contracts and subsequent debts? Was it criminal proceeding for domestic abuse or civil proceeding, ie protection order type remedies? Or was it just criminal or both? I assume it failed because you couldn't prove domestic abuse to warrant a criminal conviction (given her attacked another lady whilst awaiting court hearing)?
Hi, one of them is an overdraft for a bank account. I did not but if that would help I'm willing to try anything.

I was was provided with a lawyer but I didn't get to speak to her directly until the day I went to court before I went in, the police offer said I didn't need my own, all my statements etc went directly though the DC in charge of my case. It was not a civil proceeding but a criminal proceeding, the term used wasn't domestic violence but I'd rather not type the word, but it was three counts of this and he was given a restraining order for threatening behaviour. They explained that it was proved not guilty because I didn't have enough evidence and he pleaded not guilty, they told me if I had of gone to hospital I would have the evidence required, but when he did that I wasn't allowed to leave the house never mind go to hospital. There was also no situational evidence because it was a year later I reported it.

"Although scalar fields are Lorentz scalars, they may transform nontrivially under other symmetries, such as flavour or isospin. For example, the pion is invariant under the restricted Lorentz group, but is an isospin triplet (meaning it transforms like a three component vector under the SU(2) isospin symmetry). Furthermore, it picks up a negative phase under parity inversion, so it transforms nontrivially under the full Lorentz group; such particles are called pseudoscalar rather than scalar. Most mesons are pseudoscalar particles." (finally explained to a captivated Celestine by Professor Brian Cox on Wednesday 27th June 2012 )

First of all take a big breath -you have come to the right place. You won’t be shoved on or referred to another department. There is no closing time and we never, ever judge. Not only will you get brilliant advice from experts but they will help you to sort this and I will tell you what -nothing, and I mean nothing feels so good as when you come out on top and know you took the problems and with a bit of advice you throttled them.
Now you have been through s**te -but remember you are still standing. Just take a look at what people in the same situation have achieved on here. We all have our story but honestly there is a future and your best days are yet to come.
Now I won’t tell you it is possible to make your debts disappear overnight and I am not saying that it is not going to be scary but you are not fighting alone, you are not in a hopeless situation and, hey, you have the finest and the best advising you so roll up those sleeves and together :grouphug:we will get through. In the meantime take a browse through similar cases on here and see just how good it feels when things get sorted.

Hi nemesis45

I've checked my account on Noddle and the lloyds debt isn't even showing? Neither is the council tax or water.

Its showing 2x defaulted credit debts:

Lowell : Vodaphone £779

and

Lowell: Studio £204

im not sure what defaulted means though? Nor why the others aren't there?

So Lowell 'own' the Vodafone account now? So effectively all your 'worry' debts are with Lowell?

The council tax you are picking away at slowly and the waterbill is kind of on hold?

Default is the marker placed on your credit file to say the account terms were breached, defaults stay on for 6 years.

Yes both my worry debts are with Lowell. I'm slowly working my way though my council tax and my water bill is waiting. My only other worry was the lloyds debt but it's not showing up in either open or closed?

I'm pleased to hear that both 'worry' accounts are with Lowell Portfolio because they have responded very supportively to my contact with them today. They have a vulnerable cases team and have a good track record of intervening positively when they are alerted to a genuinely difficult and vulnerable case.

I'm so glad that you chose to share your worries, as the saying goes, 'A worry shared is a worry halved'. Well hopefully with us lot behind you and a very lovely lady at Lowell Portfolio we will reduce that worry to much less than halved!
