I got a car on finance with a company c4c which have gone into administration and they stopped taking payments then I have started receiving letters from a company called Shoosmiths on behalf of c4c saying that I need to call to make arrangements to pay the money I have left on my account I have called about 15 times left messages and emailed them and no reply. Then I received a letter stating they have terminated my contract and coming to take my car. I started my finance agreement in October 2013 and it finishes this October do they need a court order first???

Things to bare in mind:
has the debt been transferred correctly... You need to have received a letter stating when they took over account etc..
If it has, and you have paid more then a third of the agreement, then, if the car is taken, without a court order they would owe you
all moneys paid under agreement...

How long ago did Shoosmiths start writing to you?

Put anything you have to say in writing and use signed for post when dealing with Shoosmiths

Shoosmiths are managing the finance agreements of former C4C customers. The C4C contracts have been assigned to a company called Avelo, who do not have a consumer credit licence, and they have engaged Shoosmiths (who do) to handle collection and recovery.
Were you originally paying C4C via Direct Debit ?
Did you receive any notification from the liquidators of C4C at all ?
Any notice of the assignment to Avello ?
And nothing from Shoosmiths at all until letters chasing you for payment? So yes, you need to write to Shoosmiths, cc it to Avelo, and both sign for delivery. You are unable to pay without any details having been given to you of where to pay. You should not be disadvantaged by the companies failings in communicating with their customers.#staysafestayhome

Fordwyatt can you pm me please with details. To begin with you can't countersue unless they are bringing court action against you, and you can't issue CCJ's - you can bring a county court claim ( for what though? refund of monies paid? terminate the agreement? ). In what way are you acting for clients ? Are you a solicitor ?
I am concerned that you seem to have misunderstood the FCA consumer credit licence of C4C and Avelo and Shoosmiths following your post on another thread too.#staysafestayhome

C4C Have to refund Me for the Instalments that I have paid for the vehicle , they have not updated my credit file ! and the agreements that have been set up for consumers are illegal I have spent a lot of money investigating the credit agreements that C4C have given there clients , I am setting up a action group ! c4c has charged consumers for a stronghold immobiliser device that has been charged to the consumer on a credit agreements ! this and various other clauses in the agreements make the agreement a unregulated document ,and a item that cannot be charged to a consumer , I am not a solicitor but I am a consultant financial investigator and work for various agencies ! and yes a ccj can be issued against Avelo Limited and has been ! For the Retail Price of the Vehicle ! Shoosmiths are aware of this problem and have been informed !

Okay I don't think we need quite so many exclamation marks there.
So, you have issued a county court claim against Avelo Ltd ?
What stage is that claim at ?
Presumably Shoosmiths are acting on Avelo's behalf ?
Are you claiming for a refund of instalments paid or for the retail price of the vehicle ? ( you mention both so am not sure which it is)
Are you keeping the vehicle ?
The immobiliser is inoperable since C4C went under as I understand it.
The Credit File issue - as I understand C4C sold their finance on the basis that it would help you fix your credit rating, but never reported the loan or payments to the credit agencies. Companies that do report to the agencies have to ensure the data is accurate but there is no obligation on a company to report data to a CRA - and from the contract I have seen there is no mention of credit reporting being part of the agreement.#staysafestayhome

Kenneth can you help me? Currently having issues with shoosmiths. Have £1200 left on a £6400 agreement and they've lost payments, have been making them on time every month yet they're threatening to take my car away AND for me to pay the outstanding balance! The car isn't even worth £500!
