  • Reasonable adjustments - too small a business

    I have a disability, originally caused by a fall at work 3 years ago which after 2 operations I have now had a full knee replacement due to severe arthritis. I am off sick with no pay again- I have asked my employers

    a. To make reasonable adjustments and discount my sickness due my disability as i would then not be in a situation to have no sickness pay
    b. Grant some disability leave for a week to allow me to get over operation
    c. Ask them to allow me back on a progressive return for a month as per GP request from 3 days up to 5 in a Monto
    d. Pay me my full pay while doing the progressive return to work
    e. Allow paid time off for physio

    they have refused all of the above, they have had a consultant report telling them that my original accident at work has contributed considerably to the full knee replacement op early. They have said they are a small business ( estate agents with 14 branches) that there profit is important as they are a business and they can not be seen to favour certain members of staff

    anyone got any thoughts as I have contacted ACAS and they have said they do not have to do anything as long as they are not taking you down the disciplinary route re sickness !!

    What is written in your contract of employment regarding all of this

      Nothing at all in my contract but I originally worked 3 days for first few months so I had that contract then I went full time for last 3.5 years and no contract .. Just refers to manual which Hardly tells you anything apart from basic sickness you have 3 months full pay in any lumped together years then no pay
