Acusation of email tampering

Hi

I've recently been accused of changing the contents of an email I received from a cowboy builder who is aware that I have proof of his lies within the email, which is why he's attempting to discredit the contents.

I'm aware that ISP's hold certain data for up to 12 months but does anyone know if this includes email content?

Also does anyone know if I can make a subject access request to get a copy of the email in question from the ISP?

They may have contetn . What is your download set to ? Sometimes the email is deleted from the server when the email is downloaded sometimes they are retained. Look at the server settings and then approach your ISP .

Hi Cortez ..

From my understanding , ISPs do not store the content of emails although they may hold a record of email addresses etc. I don't know the context of your argument here but I suspect that the way forward is not via email retention if you can prove the facts in another way. Can you do that?

If you are using an email program to access your emails (Outlook, outlook express etc ) then try logging on to you ISP's web mail service, via a web browser, and see if there is anything there. You just might be lucky.

Thanks to all who have replied.

I've contacted my ISP and there is no copies of emails kept. I use Outlook for emails but will logon to my ISP's web mail service and see if there's anything there..................Probably not as I downloaded all messages to Outlook.

It's a shame as it was proof that the builder has been telling lies and he knows it!

Wouldn't the builder have to prove you tampered with it :noidea: (I'm not very tech-savy, but I'm sure it would be pretty hard for someone to change the wording in a received email??)

The email probably contains a bit more than you might think.

Depending on what there sender ( bit after the @ ) is, and what your receiving software is, there is usually some other info stored in the email. This gives the senders route through the internet, the sending and receiving gateways and timings, and sometimes, the bit size of the mail/file. The bit size and some other details can be rolled into a hash ( jumble of number+letters ) that can only be calculated if the email is un-doc/edited/changed

Ie, its extremely hard to change an email and not be caught out
Its close to impossible to degigh sending one if the other person hasn't edited it ( still has original )

Question, why did you delete the email? If the builder is trying to prove you tampered with the email, he will likely use it as evidence. If he does this, then you can ask for a disclosure of the email. Kati is right in that the burden's on the builder to prove you tampered with the email but let him hang himself, so to speak. Once the email is admissible refer to it as your key evidence to prove your allegations against him.

I still have the original of the email I received but that, in itself, won't prove that I've not changed it unless I can gain access to the data that crazy council refers to.

I have a lot of solid evidence against this builder and I'm aware that he'd need to prove that I did tamper with the email, but it would add weight to my case if I can prove irrevocably that he's a pathological liar, which this email does.
