  • Credit4Cars Ltd/Avelo/ShooSmiths Solicitors

    Hi everyone,

I would like to see if anyone else is experiencing issues with Credit4Cars going into administration.

Me and many others are discovering many more issues.

Please comment if you have been affected and we can all work together as a unit to get these issues sorted.

    Re: Credit4Cars Ltd/Avelo/ShooSmiths Solicitors

Hi Becca, and Welcome to the forum.

The Director of Credit4Cars Ltd, One Stop Car Credit Ltd, Credit Car Sales Ltd and Avelo Ltd seems to have resigned from them all on 31st March 2016.

It appears from Companies house that Avelo was taken over by a new Director in March 2016 about the same time all the other companies went into Administration ( Liquidators are CVP Global LLP. ) . Avelo used to be called Credit 4 Cars (2015) Ltd.

    Avelo's website states
Avelo Limited took over all HP agreements from Credit4Cars following the administration of that company. We wrote to all customers in late March 2016 detailing the process by which payments would therefore switch across to Avelo Limited.

We have appointed Shoosmiths LLP, who are regulated by the Financial Conduct Authority, to collect the repayments due on these agreements. The FCA have provided approval for Shoosmiths to collect the debts on behalf of Avelo Ltd.
The timing all seems to fit with them having had their interim permission licence withdrawn. ( EDIT: On checking yes credit4cars licence has lapsed - Credit 4 Cars Ltd Interim Permissions reference number: 644685 trading names of One Stop Car Sales, One Stop 4 Credit, Credit For Cars, Www.Credit4cars.Co.Uk, One Stop Car Shop ............... and Avelo don't seem to ever have had one - hence them using Shoosmiths )

Can you explain how contracts have been breached and what the allegation of fraud arises from ?

    Sharon

      Ahhh
We have a tracker fitted to the car from finance company but FCA investigated them for the fact they shouldn't have been immobilizing vehicles and Fidor bank pulled their finance etc.
I remember reading something about this previously will have to look it up. If you were late making a payment they switched off your car so you couldn't use it ( without warning).

Okay, if you are in a current agreement and have a vehicle bought through C4C you should get copies of your agreement and terms and post them up ( REMOVE YOUR PERSONAL INFO FIRST) or email them to me ( you already have my email )

        Re: Credit4Cars Ltd/Avelo/ShooSmiths Solicitors

The agreement does have the right to be assigned, providing the terms and conditions are not changed. They should have notified you individually of the assignment. How did you know to pay Avelo rather than Credit4Cars ? It is quite standard when a company goes into liquidation for the loan book to be sold to another company ( even if just on paper).

Have you had any paperwork from the liquidators (CVR Global) at all ? Is there a log in to the liquidators website to view the documents?

Do you have a copy of the term that states about improving your credit rating? It is normal for these kind of companies to state in advertising that having a loan with them will help improve your credit rating ( as in theory you would have markers on your credit file showing it was being paid on time each month) but there is no requirement TO report to a CRA, only to ensure that anything reported is accurate.

The breaches you have outlined wouldn't be enough to enable you to rescind the agreement and keep the car I'm afraid.

If you do have a copy of the full original agreement I'd like to see it though as we can check it over for any breaches of the consumer credit act, then you can get started on letters etc. Also need to know how much you have paid to date - any missed payments etc.

          Re: Credit4Cars Ltd/Avelo/ShooSmiths Solicitors

Ok, so I have spoken to the CEO of Credit4Cars renamed company Avelo Ltd. I explained that the terms and conditions of my contract have been breeched and that I want to be compensated, as they have reported my personal data incorrectly to the credit reference agency. I will post pictures of my contract tomorrow. I am absolutely sick of the mess that they have made of everything. I have spoken to the CVR Global team, who are the appointed administrators of Avelo Ltd. I have been told that I have a strong case against Credit4Cars/Avelo. What could my next move be? Can I take this company to court? As all else is failing. Would I have to pay a very high amount of money to arrange court procedures? I really don't want to leave this. I'm not going to stop complaining and fighting for what I deserve. I have stuck to the terms of my agreement fully. There are over 100 customers in the same boat, I have spoken to many of these directly. Does anyone have any advice on things we could do to get our story heard and taken seriously? B xx

I am also in the same boat the issues I have though are the condition of the car is shocking. I've had 9 separate faults with the car in 12 months including the head gasket blew the struts the heat shield I've now emailed them as stated that I will be paying no money and that I'm looking for them to pick up the car and compensate for the year I've had the car and all the breakdowns I've been paying for. I've not missed one payment.

I dont understand what any of that means to be honest I just want to know if the cars cn be returned or do we just get to keep them and pay nothing else and it does not effect our credit rating

                      Where to begin!

I signed with them 05/06/15 every payment was on time till march 16 when the payments got stopped, so not even a year.

I've been going through my original agreement with them, all the sums are wrong e.g total amount payable £7406.43, 1/3 of that is apparently £2552.14 according to them. Save some time it's £2468.81 which should be my full first year out of 3 @ £190.46/month comes at £2285.52. Total for the 3 years comes then comes to £6856.56. Not a maths wiz but it doesn't seem right.

Also the APR is different on the agreement to what was stated on the website. The amount of credit was for £3249.00, total charge for credit £3607.43.
                      Breakdown -
                      Interest £3008.43
                      Credit facility fee £250
                      Stronghold device £349

I would like to know why they have put the immobiliser onto the credit fee?

I have also moved house since all of this happening, I have tried phoning but I just get an answer machine I have emailed, not going to go out of my way once should be enough.

I would send the agreement buy not sure how on here.

Oh also I had raised concerns around December 2015 about a rattling on the back end of the car, as it states they will help cover costs if they believe it couldn't be helped e.g bushes wearing. I phoned they completely ruled it out without getting an engineer down to have a look, so full cost of parts and labour was on me.

Not sure what I'm looking to hear just in for a good rant about them.

(Should have gone over it in more detail but to get the car before seeing any contract I had to get to Newcastle (200 miles north) do I was pretty adamant on getting it there and then)

                            Re: Credit4Cars Ltd/Avelo/ShooSmiths Solicitors

Hi I took a car out with credit 4 cars March 2015, I paid £85 consistently for 10 months, paying over £3k. In December I called to see if my weekly rates could be lowered, but got answerphone messages constantly, I started googling the company and found out it went into liquidation in December, so I cancelled my direct debits.

I heard nothing more, and after numerous phonecalls and discussions with people in the same boat, I gave up. I then tried again in February to contact somebody to collect the car, I was told I'd get a call back, that never came. I moved house, but never received any correspondance via email or telephone, last week the door knocked and it was recovery to take my car, I am a foster carer and childminder so my car is needed. I explained I'd had zero contact with anybody, and he claimed hed been following me around with the tracker for weeks (weird).. I asked why not just knock on the door, as Im not running from anybody. I spoke to shoosmiths who claimed they sent a welcome letter and explanations in February (not received) and claimed id been sent a letter explaning the recovery (I've moved house) I offered to double my weekly repayments to get back on track as my intention was to always pay, shoosmiths refused and took the car! Now I have no car, £12k debt on my credit file, and no evidence on my file that I'd ever paid anything to them! Is there any way of getting this debt removed?? Any help would be appreciated.
