  • Lowell solicitors misled court CCJ strike obtained

    I have for couple years been hassled by Lowell portfolio and associates over an old phone debt I dispute
    got a letter today stating they obtained a CCJ at Northampton on 29/03/2016
    i rung solicitors obtained case number and rang Northhampton to confirm the CCJ exists
    what Lowell solicitors done was inform court an old address so all court papers went to an address 4 years old then updated my address with court a week AFTER they obtained a CCJ
    spoke to court £250 to get judgement set aside and they suggest I recon tact Lowell solicitors to show there mistake and get the case set aside and reheard
    just got off phone livid Lowell solicitors will not set aside, state they do not have to furnish the court current address (although they have a week after to gain awards) and refuse to put things in writing
    already now missed payments have added an extra £100 or the account
    surely these debt chasers cannot do this?
    help and advice please all posts answered and I will follow it through to end

    Why do you dispute the debt?

    Did they 'hassle' you in writing at your current address?

    Did you record the recent 'phone call? (If not, make a contemporaneous note of it & date the note)

      Sound funny I have no debt, buisness or contracts with Lowell or there mates.
      in 2012 I had a mobile phone dispute with EE and I backed the phone within few days to there shop, they accepted phone had no cover edge where I lived despite getting told reception everywhere etc
      this was early 2012
      i moved home in 2014 to my current adress
      late last year Lowell finance wrote demanding money each letter returned with I've no buisness with you
      today I get a letter from Lowell solicitors stating I had missed a court ordered payment
      I rung them and argued no court etc and told a case number
      rung court confirmed there had been a case and the court knew of my present adress
      i stated first I had heard of this and the lady checked noticed court papers were sent to adress contract was taken out a CCJ awarded then swiftly Lowells had updated the court.
      i was told this behaviour wrong to ring Lowells they would get judgement set aside and relisted
      however Lowells said no they not doing this and they not going to put there descision in a letter and advised me of ever increasing charges now I was a customer of there albeit bu default of court hearing
      i now have to pay £250 to have it set aside (I'm on benefits disabled) then challenge a future case
      dont seem fair Lowells can lie and mislead a court to obtain a judgement and contract with me
      Any advice please welcomed
