If the DJ doesn't immediately accept the Statute Barred argument (and dismiss the claim) then It might make sense to seek an Adjornment if the Claimant only provided paperwork 2 clear days before the hearing. Tell the DJ that the Defendent needs to take legal advice on this late and last minute evidence.
However since the the Claimant has not complied with the Judge's Directions to file their WS statement 14 days before the hearing I would ask for their evidence (the WS and Exhibits) not to be admitted. I don't whether a DJ would make that sanction when requested by a LIP though
