    If the DJ doesn't immediately accept the Statute Barred argument (and dismiss the claim) then It might make sense to seek an Adjornment if the Claimant only provided paperwork 2 clear days before the hearing. Tell the DJ that the Defendent needs to take legal advice on this late and last minute evidence.

    However since the the Claimant has not complied with the Judge's Directions to file their WS statement 14 days before the hearing I would ask for their evidence (the WS and Exhibits) not to be admitted. I don't whether a DJ would make that sanction when requested by a LIP though

      Hi yes I did cca they de d 19 days after the time I requested. Unfortunately with another death in my immediate family I failed to send letter stating statute barred. The paperwork is the claimants defender. I have never verbally or in writing admitted liability. Mediation was offered to plea my case I accepted and stated I needed to plea that this is incorrect but they never responded and I ended up with court paper work statutes the dj suggests mediation but claiming want sorted! Looking at paperwork it shows account opened 2007 last payment they recorded was 2008 they started cashing in 2012!
