  • Issue Of Warrant of Control.

    Dear All

My name is Deeade and I have just become a member of this great community, I need your help.

4 days ago, I received a letter from the county court business centre in Barnet. It looks like a DCA (Hoist Holdings have managed to obtain a default judgement against my wife on a debt that my wife have no clue from who or from where. We did not see any court summons. The court bailiffs are now asking her to pay £1019.28 by the 24/05/2016 or they may come to collect our belongings.
Secondly, we are renting, non of the things or even the rent is in my wife's name. what can I do, can they still come and enter our property and take things that are not in my wife's name? How do I stop this debt that I am sure is over 6years ago and is statute barred?
    Thank you?

    Deeade

Was this taken out at an old address? Do you have any proof it might be SB? The County Court Bailiff has no automatic right of entry to the home - bad mistake to let him in - but can take anything of value outside - car perhaps.

We don't even know where the debt is from. The bailiffs haven't come to my address yet. I have only just received the letter from post. Can they enter my house , although the debt is not in my name?
