Not driver of vehicle

Hi, stopped by Police and vehicle seized as not insured to drive. Outside of vehicle at time of being stopped and not the driver of vehicle. Police breatherlised me, searched me and said the vehicle would be seized as had no insurance. If I was not the driver at the time how can they take me to court for no insurance?

Who was driving then or was it stationery engine cold and no keys?

On Fishing trip friend had left me the key to the vehicle to unload fishing gear to nearby fishery.

Why did you not call your friend over to talk to the Police? Is he willing to make a statement to them in your defence?

The vehicle was seized as it was on public road with no insurance?
Are you the registered keeper of the vehicle?
Were you accused of driving it?
Were you given a "producer" ie a slip ordering you to produce your insurance documents?
Were you given (verbally or in writing) a notice of intended prosecution?
As you were not actually driving or even in the vehicle when police arrived, I wonder if the officers concerned would be stupid enough to risk perjuring themselves if this ever went to court.

I can only assume that if the police actually breathalysed you, they would be assuming that you were in control of the vehicle and they must have had reasonable suspicion to believe you had been drinking to do so. I am also assuming that there was no current insurance on the vehicle and that the vehicle was registered in your name?

So what is your defence against no insurance?
