  • no win no fee

    Hi,

I want to start a defamation case against somebody. I contacted a law firm and given them all the information including ALL the emails. They have come back to me saying that they need funds to do investigative research before they can proceed. I do not understand this as I have told them everything about the person as well. They can see from the emails that he has a good job as well.

    What should I do?

    thanks,

    Nico

It would be quite unusual for a law firm to establish whether you had a defamation claim without charging. Generally no win no fee doesn't apply to defamation cases.

Does this action refer to the emails mentioned in your posts of last year?

If so, and you are basing your claim solely on those emails sent by your ex flatmate after 1/1/2014, I think you might have problems making a successful claim under the current Defamation Act of 2013 which requires the claimant to show actual or probable serious harm.
