  • Shopping question

    Hello Everyone.

    I have recently ordered a sofa and 2 chairs from a local sofa shop. The chairs have been delivered yesterday and they have marks varying from scuffs, pitted marks, and scratches. They are brand new and cost a lot of money, I have telephoned the shop and they want to send someone to get rid of the marks and problems. The point for me is that they are brand new, I dont want someone coming out to repair something that is supposed to be new, I wondered do I have any rights to send them back for a refund?

      You have te right to return the goods for a complete refund.
      Consumer Rights Act 2015
      9Goods to be of satisfactory quality

      (1)
      Every contract to supply goods is to be treated as including a term that the quality of the goods is satisfactory.

      (2)
      The quality of goods is satisfactory if they meet the standard that a reasonable person would consider satisfactory, taking account of—

      (a)
      any description of the goods,

      (b)
      the price or other consideration for the goods (if relevant), and

      (c)
      all the other relevant circumstances (see subsection (5)).

      (3)
      The quality of goods includes their state and condition; and the following aspects (among others) are in appropriate cases aspects of the quality of goods—

      (a)
      fitness for all the purposes for which goods of that kind are usually supplied;

      (b)
      appearance and finish;

      (c)
      freedom from minor defects;

      (d)
      safety;

      (e)
      durability.

      (4)
      The term mentioned in subsection (1) does not cover anything which makes the quality of the goods unsatisfactory—

      (a)
      which is specifically drawn to the consumer’s attention before the contract is made,

      (b)
      where the consumer examines the goods before the contract is made, which that examination ought to reveal, or

      (c)
      in the case of a contract to supply goods by sample, which would have been apparent on a reasonable examination of the sample.

          Thank you for your reply. What do I do from this point, I dont want brand new furniture being repaired, am I entitled to a full refund or can they say no. I just worried about how to handle it.

            Contact the shop and tell them you are rejecting the goods under rights bestowed by Consumer Rights Act 2015.
            You require them to collect the goods and refund your money (or replace the items with new if that is acceptable).
            Confirm your telephone conversation in writing.

            If they don't co operate you then have the opportunity to make a chargeback claim or to initiate court action
