    Hi everyone,please advise,
    I have recieved general form of judgment or order
    1. The defendant having failed to pay the fee(and indicating that he does not intend to pursue his counterclaim),the counterclaim is struckout

    Can you tell us a bit more about the claim. Is it against you or are you bringing the claim ? If against you, did you make a counterclaim ( or indicate in your defence you intended to ?)

    It means, basically, that the claim will proceed as a defended claim however the counterclaim element will not proceed as it has been struck out.

      Hi thanks for your reply
      i am the claimant owed money for work completed from builder,this order states the defendant has a right to set aside,varied or stayed with application to court with any appropriate fee within 7 days
      do i have to do anything with this order

        Okay - it's in your favour then and no you don't need to do anything - did you receive a copy of the defence from the defendant or the court ? It appears they indicated they wished to counterclaim against you but failed to pay the fee... they have 7 days to argue about it or their counterclaim is struck out - the claim will continue as a standard defended claim otherwise. You should get a notification from the court to confirm you wish to proceed and a directions questionnaire.

          Hi i did receive a copy of the defence from the court
