    Hi Im new to the site , as many people who come across a ccj will be , so id like to say any help possible will actually be much appreciated ,

    i was looking on my clearscore profile and seen that i have been issued with a ccj , i was absolutely shocked , it was july 20th 2015 , so i automatically rang county court business center , gave them the reference XXXXXXXX , and was give bwlegal number , i rang them and they said it was from 2005 with land of leather , (creation finance) i know i should of paid this but in 2005 id split with my ex etc head in bits the sofa was for her , etc joined the army , i had a few letters to my mums etc asking for payment etc , i didnt end up paying , i was 19 at the time , total different to situation in life im in now , ive never replied or spoke to these people in over 10 years , how is it possible i have a ccj from them , its my own fault granted i paid for 12 month and stopped and its now over 10 years since paying and this ccj is ruining my chance for a mortgage with my daughter , if there anything that can be done .

    The choice is ignore and get on with life or apply to the courts to get this judgement set aside. It may be difficult after this time but as you have only just found out it should be possible, It will cost £255 though!

    Your debt would have been statute barred, meaning they should not have taken you to court to get payment of the debt. This does not kill the debt, just makes it unenforceable.

    Others will be along who know the process.

        When exactly did payments cease please.
        Do you recall when this account was defaulted, if you are going to apply for the judgment to be set aside on the grounds that the debt was stature barred on or before the claim was issued you will need to be accurate,

        I presume BW Legal was most likely acting on behalf of Lowell?

          yes bw legal on behalf of Lowell ,

          last payments where made in 2006 , I have since then never had any contact whatsoever 100% with creation who the finance was with , or any firm of debt companies etc ever since , so I'm assuming 2006 it was defaulted , hope that helps ,

              yes they can, BUT did you receive N1 county court form from them when they instigated proceedings, if so did you respond and follow procedure? using a statute barred defence?
