Hi all,
Hoping someone can help. My husband checked his credit file for the first time last year. he noticed there was a CCJ registered in 2014 by Bryan Carter Solicitors working on behalf of Lowell. He didn't know anything about the debt, after speaking to the court it was found to be an old phone contract. He hadn't heard anything from them since cancelling so didn't realise there was an cancellation charge. He contacted Bryan Carter asking them to agree to set aside the CCJ if he paid it in full (he doesn't deny he owes it, he just didn't know about it) they refused the offer & he was going to apply to the court for the set aside but today we have heard that Bryan Carters have gone bust & all the debts have returned to Lowell's in house solicitors.
I was just wondering if because Bryan Carter said no to agreeing the set aside would it be worth asking Lowell's solicitors & would they be more likely to agree?
Or if he told them that Bryan Carter had agreed to set aside but then they went bust? I know its bad to lie but he has never had a debt in his life, his credit report is perfect except this CCJ. I am pregnant & we want to buy a house & get settled before the baby comes but the mortgage companies won't touch us with his CCJ
