  • Car Insurance Advice - Registered Keeper and Third Party Claim

    Hi All,

    My partner had an accident in my car after dropping off his daughter at school. His insurance covers him third party on any other vehicle.

    He was essentially emerging from a junction, however it was onto a double lane road, with traffic lights ahead (on red) and stationary traffic on the inside lane. He had cleared the junction, into the keep clear box and was about to turn right when the vehicle in the outside lane hit my car. This is apparent from the damage to my vehicle as it is scraped and dented along the driver side door.

    He contacted his insurance provider (Aviva) immediately to explain the situation, and naturally - we expected that the other driver would claim it was my OH's liability. Since then, the other driver has put a 25k compensation claim in place for whiplash etc (the works!) This is now in dispute between my partners insurance and their insurance.

    I am not concerned about the damage to my vehicle, however I recently contacted my insurance provider (Hastings Direct) to change my vehicle over to find that there is a claim open for this incident with them.

    Can anyone help? I don't understand how the incident should have anything to do with my insurance provider as I will not be making the claim. Also, I'm not sure what implications this will have on my policy should the fault come back on my partner?

      The incident will have been logged with your insurers simply because the vehicle is listed on the MIB database as being covered by your insurers.
      If it turns out for some reason your partner is found liable, and also that Aviva were not his insurers, then your insurance might be involved.

      As you were not driving, and the driver was insured under a different policy it should not affect you at all.
      You would not be required to declare this incident on any future proposal.

        It seems to me that your vehicle registration has been connected through the insurance companies claims database on a registration number basis, despite the claim being handled on a third party basis via your partner's own motor insurance. So the vehicle has been 'tagged' in that way. IF you think about it, the claim could have been handled via your insurance ( had you partner been a named driver ) or via his own insurance, on third party risks only. I guess the tagging of your vehicle is a measure to prevent fraud.

        I am not sure if you would be required to report the accident to Hastings Direct as presumably you are the registered keeper and damage has occurred to it. It may be that is something that insurance law requires. Did Hastings Direct make any comment when you told them?

        Did the other driver deny liability at the scene of the accident and did he report personal injury at that time? Were the police in attendance? Are you assuming that it was your partner's fault? Since the claim from the third party is so large, was there any evidence that this may have been a 'cash for crash' claim? Since the other driver has since come back with notice of personal injury, has you partner reported this to the police, as would probably be required?

        It's difficult to comment on liability here and a sketch of the situation would be helpful.

        PS ..... when an 18 year old driver ran into the back of me about fourteen years ago, while he was on his mother's insurance policy, and he decamped from the scene ( he was scared, according to the police ), I suffered whiplash that was extremely painful and I received the princely sum of £1500 for that.
