    Re: Hoist/Cohen Vs whattodooo

    Hi All,

    An update:

No response from Howard Cohen to my CPR chase letter which I sent recorded delivery on 24th April 2016. Not even an acknowledgement. They received the letter on 26th April 2016. (The original request was sent 25th March 2016, they replied with an acknowledgement letter).
My letter went "............To ensure compliance with your CPR 31 duties you should have supplied the documents within 7 calendar days ie 8th April 2016..........I now respectfully request that you supply the documents within 5 working days".

Should I now complain to FCA? I didn't mention this in the chase letter for fear of provoking them into action.

What do you think my next steps should be?

    regards

There is no penalty for non compliance with CPR 31.14, you cannot " complain" to the FCA but you can send a report on the conduct of the claimant in your case.
Cohen I would expect to parrot the industry standard response of " you would have been given a copy of the agreement when the account (s) was opened, and in any case the claim will be allocate to the small claims track.

You put their non compliance into your defence.
