    Hi all I know I have posted here before but can not find my earlier posts.

    Anyway here is the short version of my story & problem.

    I ( or some one in my family, for whom I take responsibility for) ran up a debt of over £9,300 a lot of money, this was @ 2010.

    being a family in crisis at the time & I was being treated for depression, I could not pay my bills. To their credit Lloyds TSB phoned me ( it was New Years Eve & said they would default the account & stop all charged.

    They then hired moorcroft to collect the debt. They agreed & I have a letter prooving it that I could pay £10 a month. I set up a SO not a DD ( as advised) & have never missed a payment in 3 years or more.

    However, none of my payments have ever been credited to my debt. Infact, when I got the bundle of statements for £10, Moorcroft had claimed I was in default & hadn't paid them. they even claimed they had sent a person around to my house which is not true as at that time I never left the house & no calling card was left.

    Then just over 2 years ago my heavily pregnant highly strung daughter was sent a letter at her boyfriends parents address from cabot ( I think) saying she owed the full debt.. She was distraught, his parents were mad & I had never even met them !!!! I said ignore it as they are illeagally phishing.

    So 2 years later I get a phone call from Cabot. Lazy me spoke to them on the phone & said I have not heard anything from Lloyds nor the DCA I currently pay so I can not pay you anything as I am already paying a DCA.

    Then the letters started. they claim they have bought the debt although LloydsTSB have not notified me & Moorcroft still continue to accept my monthly payment. The amount Cabot want is the amount before I started paying Moorcroft about 3 years ago.

    More importantly, they keep sending me letters saying
    "We have recently confirmed that you live at the above address"

    However, the address they send my letters to are like this.

    (Fictional address, ( Mine 2 silver linings, daughters boyfriends parents address = 8 horse stables)

    8 2 horse stables
    silver linings
    towen
    GB.

    So sorry to be so long winded but if moorcroft are still taking my money even though they deny it but I can prove it with bank statements, If lloyds TSB have not informed me of the sale of the debt, Cabot have not even got my address right what route do I go ? I know about the 3 letters but does my phone call equate that? Will they continue to put my daughters partners parents address on the letters ( although any idiot will know that their address has a different telephone code to mine. & why should I pay Cabot the money already paid to Moorcroft.

    I know a very long & confusing post but I am actually ready to tackle this.

      Hello Thinksalot.

      Can I ask please in whose name is this account?
      It would be worth checking credit files to check which company is reporting
      to credit reference agencies confirming the owner of the debt.

      A formal complaint to Moorcroft regarding the payment you have made to them if you have the SO recorded on your bank statement send the redacted copies of the statements for proof.
      Moorcroft were supposed to pass payments to Lloyds is that correct?

      If so you will also need to raise a compliant with them as well. you should also be receiving statements at least annually show payments made to this debt make that part of the complaint as well, together with the fact you have had no notice that the debt has been assigned to Cabot.

      Put Cabot on notice that there is a serious dispute being raised with Lloyds and Moorcroft regarding the payments that have " gone missing" ( Ken Stannard is the CEO of Cabot so I would address that part to him personally.

      I have seen a similar " foul up " where a person as a "3rd party " such as you seem to be in this, paying an account on which there is a different name i.e. Joe Bloggs paying an account in Mary Bloggs' name.
      Where payments in this case were allocated to a new account not the original account.

      You don't pay Cabot a penny until Lloyds and Moorcroft come up with an explanation for this.

        Are you referring to the "3 letter process" that claims to be able to get debt purchasers to write off any debt they have bought? If you are, then I suggest you forget it - it has no legal basis.

        Have you tried phoning Moorcroft up and asking them where your £10 a months are going to? If that doesn't prompt some very hasty reconsideration, i suggest you put in a written complaint to them about it and inform Cabot of the dispute.

          Yes, you do have to wonder if MoronCroft were ever accepting payments in relation to the same account. They have a track record of similar sounding cases.
