    Hi!

    one of the helpful guys at MSE recommended signing up here.

    im looking for advice on the next steps.
    i found a CCj registered to a previous address and couldn't get any sense out of the company who filed this (Capquest), including a definitive answer of who the supposed debt was with, so I applied for a set aside.
    i relied on initial Google results to assure myself that telling the truth would be enough - I don't owe this, it isn't mine. The company they state the debt to be from has denied it. And further I never received any correspondence relating to this including any court forms so had no chance to defend. I can also see the CCJ is registered to an address I lived at for a short period one year prior to the CCJ.

    obviously I failed as I didn't have paper evidence.

    i have now written to the company requesting a SAR and intend to appeal/apply for a further set aside but need some advice.

    if this is the best place, I'm happy to post full details?

    Will need to see a copy of your set aside application ( sorry - just type out/copy paste sections 3 and 10 and remove your person details)
    What you sent - just the N244 form ? or did you send a draft order and witness dtatement & draft defence ?

    Did you attend a hearing ?
