  • Drysden Fairfax Letter

    Good afternoon all, this time last year I beat Lowells and managed to get my other halfs debts Statute Barred due to your help and assistance and templates.
    Today however, her indoors received a letter from Drysden Fairfax Solicitors basically saying they have been contacted by a business partner and she should contact them by phone.
    Luckily she ignored the letter and didn't phone them so the education from last year worked!!
    There is no mention of debts, who the business partner is just saying they want to resolve the issue.
    My questions are straightforward hopefully, do I write to them or wait for the next letter, if these were dealt with by Lowells, why have this other company started trying to get them paid, is this harassment? Or should I start preparing the letters again, £1 postal order etc..?

    Firstly, you should have been sent a deed of assignment to say whom is now dealing with the debt.

    Have you ever asked for a copy of the credit agreement under section 78 including the £1 statutory fee?

      Hi Spellkaster, I did last year for Lowells and made a complaint last year to their customer liaison manager. The letter today came out of the blue and it contained no information except to contact them which I am refusing to do, taking the advice from last year there is no way I am phoning them...Basically I believe I should wait until they actually send details or a bill and then I shall ask for the credit agreement etc...is it right that Lowells can sell my partners debt on because they were beat last year!!

      Checked again Spellkaster, there is no reference made to any other company but Drysden Fairfax!!! Quite bizarre

      Lowells sent the documentation, what little they had and my postal order back, may have to use it again!!

        This is what I would be doing :nod: ... unless they tell you (in writing) what debt they believe you owe there's not much point (IMO) of asking them for details :fish2:

            A Notice of Assignment is what is sent by the creditor and or the debt purchaser.
            A Deed of Assignment is the contract for the sale of the debt by the creditor to a debt purchaser
            this is considered a confidential and commercially sensitive document.

              NEM, it wasn't any of these, I believe they were fishing, it was a generic type letter from them asking my partner to phone them...not a chance...no details whatsoever, worded as though it was "we have some outstanding business with one of our partners, can you confirm address, phone number, email etc by phoning us immediately"
              I will wait to see their next letter and give this forum an update when it undoubtably arrives.

                That letter breaches their own associations (CSA) guidance on debt collection letters for a start.

                I would like a copy to be sent to the FCA their " client " instructs them how to act and is ultimately
                responsible for the letter.
