  • Help Urgent : Fredrickson International threatening action for old MBNA

    Hi everyone,

    Account Details:

    Acc type : Credit Card (2000/2001)
    Balance : £6550
    Original Creditor: MBNA
    DCA : Fredrickson International
    Date of last payment : 2008



    I need some urgent advise about this old account for a credit card from MBNA. The account from my calculations and examination of the docs that I have is statue barred.

    However recently I have been receiving demands for payment from Fredickson for the account.

    I have spoken to them by phone asking that they send me a Credit agreement before I can comment any further about the account. Do the telephone conversations asking for the credit agreement affect the statue barred status????

    They have tod me to send in a CCA request with a £1
    payment.

    However I am reluctant about the £1 payment as from previous experience I know they can end up being credited to account.

    What I would like some advise on for know is how to cover my back with CCA request, what do I need to keep a record of and what do I need to photocopy when I send the £1 payment with the CCA request.

        Good morning Phantom

        To avoid the statutory fee being allocated to the account use a postal order endorsed " For Statutory Fee Only " take a photocopy
        and keep it with the signed for post receipt.

          Sorry for sounding like a bit of an idiot here, but can you explain exactly what you mean by "Endorse the postal order - Statutory Fee Only"??. Do I write on the front or the back of the postal order "Statutory Fee Only" or do I get them at the post office counter to print something on the back or the front of the postal order..??

          Its very important this point as I don't want to risk the £1 statuatory fee being used as payment to reset the statue barred clock.

          I need to have this point quickly cleared up so I am clear about exactly what and how the postal order needs to be endorsed as I have to get CCA request off on Monday.

          nemesis can you please clarify this point for me as quickly as you possibly can. Thanks.

              Write For Statutory Fee Only on front and back of the PO then photo copy it some of the Debt Purchase Companies are playing silly buggers with CCA requests and the fee payments.

                Hi everyone,

                I can't believe it.
                I did exactly as above for the CCA request, and guess what.
                I have recieved a reply back saying that the request is being processed but the balance is showing as £1 has been credited to the account.
                It looks like as the cheeky c**** have credited the statutory payment to the account.

                Please advise what I should do about this. plz.

                  Make Formal Complaint to Fredrickson state that you require them to amend the account removing the payment wrongly allocated, you can also tell them that you believe that this is an attempt to change the status of the alleged in regard to the Limitation Act 1980.
                  Address the complaint marked " Private & Confidential" to Andrew Bartle who is the Chief Operating Officer of the Lowell Group and on the board of Freds.

                      OK, CCA as said should have gone to the claimant CPR request goes to solicitors.

                      Do you need help with a letter.

                        The CCA request I sent went to DRYDENS Solicitors and they have now confirmed in writing that they have forwarded it to their client and have placed the account on hold until that is being processed.

                        However from the balance shown on the latest letter it is obvious that they have taken the £1 statutory payment and credited it to the account.

                        So yes now I need help with a letter please ASAP and I need to know where this letter needs to go as the postal order was sent to Drydens and they are the ones who seem to have credited it to the account. Thanks.

                          Raise a formal complaint as said with both DF and Freds,.

                            Re: Request made under the provisions of Section 78 Consumer Credit Act 1974 ( as amended).

                            Formal Complaint: Misappropriation of Statutory Fee:

                            Dear Andrew Bartle / Phillip Holden,

                            I refer you to my request for a copy of an MBNA CCA 1974 regulated agreement made on..........................

                            Drydens Fairfax confirmed that it had passed the request to its client Fredrickson International on.............................. and had placed the account " on hold" while the request is processed.

                            However upon checking the balance off the alleged debt I find that the £1.00 statutory fee has been used a payment towards the alleged debt, presumably Drydens Fairfax was following its clients instructions in so doing.

                            Having been made aware that any such payment allocated to the alleged debt resets the relevant 6 year period in regard to section 5 Limitation Act 1980 I believe from my research that such misappropriations of statutory fees is not uncommon.

                            I therefore require Fredrickson International and its legal advisor Drydens Fairfax to remove this payment from the records and to confirm in writing that this has been done.

                            Please be aware that should this matter become subject to litigation the conduct of both companies will be brought to the attention of the court.

                            I am preparing a report on this matter for the FCA in regard to this matter.

                            I now expect the document (S) requested are supplied within the limit laid down in CCA 1974 i.e. within 12 + 2 Working Days from the date the request was received considering that Fredrickson should have such documents to hand prior to pursuing an alleged debt this should be routine.

                            Yours sincerely
