Hi, my partner's 1993 CSA scheme comes to an end this month. For the past month he has been trying to negotiate with his son's mother to agree a new Family Arrangement.
During his discussions/investigations it came to light that he should have stopped paying the Carer Allowance portion of his payments in Nov 14 after his son turned 16. The CSA confirmed he should have been paying less since that date and that they'd "look into it" and he "may" be entitled to a rebate.
Surely if he has overpaid this money in all good faith and he was unaware the CSA's own rules should have removed this portion of maintenance in 2014, he is completely entitled to his money back?
Does anyone know if the CSA claim this back from the mother before they can make any repayment to him?
