  • Defending a claim for Breach of contract / debt recovery

How do I word a defence statement
I have received a claim for Breach of contract / debt recovery.
My daughter had a contract with a child minder, the child minder is claiming that no monies have been paid and there's an amount outstanding.
My daughter says she paid but didn't receive any paperwork by way of invoice or receipt so can't prove payment.
The Child minder says that I am a co-defendant as I am contractually responsible for payment and outstanding monies.
I accompanied my daughter to a preliminary visit when my daughter signed the contract, I was asked if I would be guarantor, I advised no. My details were taken as an emergency contact and asked to sign for that and as witness. I agreed to this. My name does not appear in the contract name, just signed in the signature boxes.
I was not given a copy of the contract at any time and after requesting a copy from the solicitor, where I signed does not say witness, just signature...
But there is a statement above that says anyone signing is agreeing to pay.
I was not contacted at any time to be made aware there was a problem until I received a default notice after the contract had been cancelled by my daughter
My daughter offered to pay so she didn't get a CCJ against her but the repayment offer was denied.
    Any help would be appreciated.
