Hi am new to the site so not sure how it works il try to explain the best i can - My mum was in hospital november 2003 she was in for 6 weeks, while she was in hospital her then partner hounded her to sign for finance on a car as his friend worked for the car company and could sort the finance out so she got it for him in her name she had no job no saving but managed to get about £10,000 finance, she was picked up at the hospital still in her hospital gown and took to the car show room and signed for the car and then taken back to the hospital, where she stayed for around another 3 weeks basically it was a big con she had been robbed by her partner who then left her a year later he didn't make 1 payment my mum paid it for around 2 years when she then informed them to collect the car as she would not be paying them as she was under medication when signing for the car and was picked up out of hospital the person who sorted the finance knew this, they came and picked the car up and over the next few years she got about 5 letters and then nothing for around 8 years until december 2015 she got a letter from northampton county court wanting £10,000 from her and she had to summit her defense - her defense was the loan was statue barred and that she's in very ill health she has copd stage 2, heart diesease and is on her 3rd stroke there is to much to list on her medical condition. She got a letter this morning off the solictors basically saying your defense has no prospect of success as their clients have gave them information saying the last payment received on the account was in 2011 which would make it in the 6 years they also say -0 we note from your defense that you are currently of ill health, our client takes such matters very seriously. we subsequently ask you to provide ourselves with the evidence of your ill health, within the next 14 days as well as your permission to inform our clients of your ill health, if you are unable to provide the evidence we ask you are now willing to withdraw your defense. Should she provide her medical file? and ant help would be very much appreciated on where to go from here she doesnt need the stress she knows she was stupid for signing for the finance, she is currently -£500 into her over drafted lives in a rented property and has no assets, thanks

did your mum ever send a SAR request (asking for details of the info they hold on her)??

Ok, a few questions first.
Who were the original lenders?
Who 'owns' the alleged debt now? (if different from original creditor)
Who are the solicitors?
What kind of agreement was it? (ie HP, credit sale, etc)

Hi thanks for response she can not remember with her having strokes her memory is really bad as far as she is concerned she has had no contact with them since she told them she wouldnt pay, but the date on the letter was checked and there is a payment for £10 to black horse who were the one's who provided the finance. Hillesden securities limited have the debt now i think and are using a local solictors restons, we have been the doctors and got her medical file but dont know wether to provide it or not. am not sure what finance it was they have gave us no documents saying what it was alls it says is the claimant claims payment of the overdue balance due from the defendant under a contract between defendants and black horse ltd
