  • Ccj help !!

    Wondered if anyone could help as myself and my partner have just applied to get a mortgage and a ccj has been found on my partners file from just before Christmas for an amount of about £1000.
    Stressed as we didn't know about the ccj going to court or we would have paid it straight off. We have literally had no letters about this at all.

    To be honest my partner thinks it's a debt from about 6 years ago and thought it had dispeared (i know he should have simply paid it). But surely he should have been informed the debt was still outstanding and going to court etc
    Other then that we are squeaky clean and I am so stressed becAuse this will totally jeopardise the chance to move me and my children to a larger home! I can't get a mortgage on my own as we need both incomes to borrow what is needed.

    Does anyone know if we can pay this and get it removed off the file ? If only we had known before Christmas it could have been settled straight away.

    Good afternoon welcome to LB,

    Could this debt have arisen from an account at a previous address and the creditor was not
    informed of the address change
    Does your partner know who the original creditor was?
    What type of account is this?
    Which company has obtained the judgement?

    Does he know when the last payment or acknowledgment was made on the debt?
    It may be worth doing a credit check on the debt, you can use Noddle it's free online.
    he will have to show that he has a defence to the original claim that has a reasonable
    chance off success.

    You can apply court for the judgement to be set aside, ( Court Form N244, Fee £155.00)
