Hi really hoping someone can help me out with this matter. After moving house last year I received a couple of letters from Lowell regarding an old Capital One debt which was for around £120. I had lost my job and capital one refused lower payments (be interesting to see if PPI which should have covered me?!) They had bumped the price up to £260 and were offering a 50 percent discount. A couple of weeks I received a letter from Bryan Carter asking for payment on behalf of Lowell of £342 and then a week or 2 later a letter from northampton county court stating bryan carter ccj on behalf of Lowell for £462. I immediately sent SAR to Capital One and replied stating I was defending the claim. The upshot is I never received any info from Capital One they completely ignored my letter but kept the £10 postal order.
The court wrote back to me saying they had received my defence and were awaiting reply from the claimant of whether they wanted to continue the claim or not. Heard nothing until around 2 months later in June when the CCJ came through the door saying it had been granted as I had ignored the claimant request to go to mediation of which I had never received. As I was going away for 3 weeks and hadn't the time to sort it out straight away I paid the CCJ in full as I was told that if paid within 30 days it would not go on my credit file. I had an existing CCJ which is due to be removed from my credit file this year so really didn't want a fresh one going on. I have proof the debt was paid 6 days after the claim issued and yet the CCJ is still on my credit file as unpaid. Lowell marked the debt satisfied on my credit file but not the CCJ.
Basically I'm unhappy about the whole matter. Ideally I'd like to challenge the amount as I believe it to be incorrect with so many charges added on etc. Hoping I haven't left it too long or shot myself in the foot by paying the full amount to avoid the CCJ staying on my credit file. I have no idea who to contact now, Capital One, Lowell or Bryan Carter. At the very least even if I can't argue the amount out now I would like to have the CCJ removed from my credit file as it was paid within the 30 days. Please can anyone advise me on what to do next.
