      At this point no Ali, if the breach of the CCA request continues without response then
      the debt cannot be enforced anyway.
      If the claim progresses then you will later have to make a witness statement and
      the non compliance will be included in that.

            Imho, nem's letter (above) clarifies that the reason for a 28-day extension is completely down to the claimant being unable to produce documents which they are legally obliged to produce within 12+2 days.

              Just to update, I have now written to Cabots twice. The first was the template CCA request with cheque on 8/1/16, I then sent a second letter asking why they had not reponded to the first. I have not had any reply from them. However I've had a letter from their solicitors Restons asking for proof that I sent the CCA request and cheque. I have a copy of the CCA which I've sent to them but the cheque has not been cashed by Cabots. Can anyone advise me if I can do anything more. [MENTION=55034]nemesis45[/MENTION]

                Hello Ali,

                This is becoming a regular feature with CCA's and Cabot /Reston there are far too many such claims of not receiving
                CAA requests and / Or the stat fee.

                            Time to register a formal complaint to Carboot with copies of the signatures also copied to Restons

                            So same letter to both

                            Restons Addressed to Nigel Petrie Coe Cabots to Ken Stannard the CEO.

                            Dear,

                            I refer to your letter dated xx xx xxxx requesting proof that I have sent a Request made under the provision of sections 77/ 78 and or 79 of CC 1974.

                            I am aware that a considerable number of these requests are being queried by both Cabot and it's instructed legal representative Restons Solicitors as either
                            not being received and /or not accompanied by the £1 .00 statutory fee, however having taken advice on making the request I used Royal Mail signed for post
                            and have the Royal Mail confirmation of date delivered and a copy of the recipients signature ( see attached) .
                            Considering the number of such occurrences that I have seen I am copying this complaint together with copies of the signature to the FCA.
                            Cabot is now in breach of my lawful request for information and the alleged debt remains unenforceable, should this matter go to trial the conduct of both Cabot
                            and Restons will be brought to the attention of the court.

                            Yours etc.

                            As said same letter to both named recipients as above: Marked Private & Confidential legal documents.
