I have today received a fixed penalty notice for littering. I was stood outside my local train station rolling a cigarette when the filter (very windy day) was blown out - I saw it hit the floor near my feet but then it blew away. I finished rolling the cigarette and then a man dressed in black walked over and fined me for littering, claiming I was on CCTV & saw the filter hit the floor. He also stated it was equivalent to dropping a cigarette but, which is debatable, but fine. I'm convinced he came to fine me rather than other people who were smoking and dropping butts since I am pretty non-threatening looking. The fine is £80.
Do I have a grounds for contesting this fine and what should I say if I do so? I believe since it was an accident I should not have to pay. I am also confused as to how a filter tip could be caught on his CCTV camera (attached to his vest).
