Recently, at work a new rota was implemented with the objective of providing greater flexibility and fairness at work. There used to be disagreements between certain people so the rota come into place. We were also informed that we could change the rota amongst ourselves as long as we informed management. I for once saw this as a perfect opportunity to do the earlier shift, as I wanted to study in the evening and was going to take exercice classes. Hence, between myself and another colleague , there are two of us in our target market, we agreed that I could do the earlier shift as my colleagued prefered to do the evening shift. This was just perfect for me. I used to work really hard on the late shift and I seemed to answer 75% more calls that anyone else. So the change was great for me again because the late shift was not supervised and some people just didn't do any work. Between the two of us we agreed to fix the rota for the next 4 weeks, meaning that I would start at 8 am to 5.pm and my colleague would do the 9am to 6 pm. Management was informed and everything was fine then. But unfortunately two weeks later into this change the Operational manager decides to change the rota. He said that he was loosing calls in the evening and he had to make an operational decision. So, he decided that he was going to fix my shift only, which meant that I would no longer do the early shift. I would now be confined to the late shift as well. There are 16 people in my campaign, 4 different markets, and only I would be suffering a change in my contractual hours and he wanted an immediate start to this. It does not seem fair that I am the only person who's hours are being fixed!
I sent an email voicing my opinions and asking him to him to reconsider, but is too stuborn and proud to see that I actually have a point.
I am a member of a trade union. I have also contacted accas and they said, based on what I told them, that he cannot do that. But I would need to check the terms of my contract first. Everyone is on a rota except me. I had signed the rota agreement in which said that the onus was on the company. The question is can he fix my hours like that? No else is being affected. I want to appeal as I feel discriminated against. Do I go in early in protest or do I go in for the late shift untill this situation is resolved. He is only changing my shift because he cannot be bothered to tell the people in the evening to their work. what can i do? Do I raise this with HR even though he said he already discuss this with HR. There was no consultation period applied and he wants me to do the late shift immediately.
