  • JBW - not accepting repayment offer

    Good afternoon all,

I am currently trying to liaise with JBW over an overpayment of salary debt from a past employer.

I am a single mum of a disabled child, and I am severely in debt with approximately 18 other creditors, who thankfully, have all agreed re-payment plans, and my debts are slowly being paid off.

I have provided JBW with my budget, a financial statement which shows my other debts and repayment amounts to other creditors, and I have also provided bank statements for the last 3 months.

I have sent various emails to JBW over the last 4 weeks, and have asked them to accept my offer of £15.00 per month (which has been worked out on a pro-rata basis), but they have refused, they want £50.00 per month, which I can not afford. I have already explained that I owe sveral other creditors the same amount that I owe them (£1,000), and that I give them around £15.00 per month, and that it would not be fair on the other creditors if I gave JBW more.

I constantly receive letters from JBW stating "that as I have ignored them, and have not either paid in full, or made other arrangements for payment, that they have now passed my debt to their recovery team", and that "they will attend my premises without further notice".

As mentioned, I have sent them around 10 emails, which are largely ignored, and they have refused my repayment amount and have asked for a sum that I can not afford. I refuse to speak to them on the 'phone as I prefer to have all communication in writing. I did call last night though as I still had not received a response to my payment offer made via email, and came home to another threatening letter, and it was during this call that my offer was refused. I was told that "they could not accept my offer, and could I pay £40.00?". I explained that I could not afford that, and then I was informed that that was all they could accept.

Does anyone have any advice on how best to proceed? I believe that I am classed as vulnerable as as I am lone parent of a disabled child, and I am in extreme financial hardship. I plan to email them again with my offer and ask them to reconsider. I am also planning to complete their complaint form as they have largely ignored me and are now asking for more than I can afford, and thought that I may contact the CAB, but I know that the waiting list for appointments is very long.

Any help and advice will be greatly welcomed.
