      I never contacted them in writing nor via the phone and I have never requested a copy of the agreement from anyone who has contacted me with regards to this matter.

      Same as above I just never responded & buried my head in the sand - Unfortunately depression was particularly bad from 2010-2013 and I totally shut down.
      3. What about Wescot who were they acting for?
      From what I can see from the letter, in the columns on the right - it says ON BEHALF OF Capital One.
      4. Was Power To Contact just tracing (phishing) to check you out?
      The letter just stated - "We have been instructed by our client to visit your address to collect the above debt.

      I have taken some photos of all the letters I have received from the DCA's and I will post them shortly so its easier for you to see my situation.

      It seems odd that the debt has been through these companies and no action has been
      taken until Cabot gets it's grubby hands on it.
      I know, Its really confused me :/ - I don't understand it at all as Cabot only made contact on 22nd October and are now threatening a CCJ less than 3 months later but the others let it trail off? unless it because I was moving around a lot!

      Next get a CCA request sent to Cabot asap, there is a template in the forum library for this.
      I have that letter all ready n waiting - Do I sign the letter ?? I have read conflicting evidence on this - If I don't sign it will get sent back n if I do sign they could pinch my signature....If I sign shall I sign it with a thick printed line through it to make it difficult for them to pinch and not in my usual signature?
      A statutory fee of £1.00 has to be paid ( use a postal order endorsed " For Statutory Fee Only".
      Sorry for appearing thick ... but how do I endorse the postal order fo statutory fee only, is it something I write on it??
      Cabot has 12 + 2 Working Days to comply.

      The letter Mike770 referred to is a reply to a letter before action (not an actual LBA)
      Again, Please excuse me for appearing dense, What is this please and do you have a link for it so I know I'm doing the right letter please.

                CCA letter & £1 postal order sent to Cabot Financial and a letter sent to Mortimer Clarke along with a copy of the letter I sent to Cabot for their reference ...... Guess its just a waiting game now?!

                  The others are dealing with this problem debt.

                  But you have others? If you stopped paying them about the same time, then you are probably going to be getting a lot more correspondence and possibly court claims in the next few months before they become statute barred.

                  We are currently living solely off my husbands wage which sadly isn't enough to cover our current financial obligations - Our Income & Expenditure list that we have drawn up to help us deal with our creditors, clearly shows we we are in trouble and have MINUS £280 each
                  month
                  Is this minus figure taking into account debt repayments? If it isn't, then how are you managing? It's usually possible to cope with a small negative budget, but not one that large.

                  Are you renting or buying? Are you claiming all the benefits you are entitled to?

                    Hi Debt Camel,

                    This minus figure only takes into account HMRC business debt x1 other is awaiting action with the DM Department, Previous Council Tax debt that is with a Bailiff, Court Order for previous Rent after being made homeless - HMRC Tax Credits Overpayment has been placed on hold by them as a direct result of or income & expenditure ....... All other debts are being dealt with as best we can as they come through.

                    We are trying to survive the best we can by juggling money, paying one person one month & not the other & vice versa ... Shortfalls & offers of money are currently being paid from our food budget, My husband and I sometimes skip meals in order to cope, not ideal I know but unfortunately necessary.

                    We rent Privately, have no assets and claim all that is available to us.

                        That can't go on ...

                        I think you need advice on your whole debt problem. With priority debts such as HMRC and council tax arrears, the answer is probably going to be bankruptcy or a Debt Relief Order (DRO). These would have the advantage of also getting rid of all the other consumer debts that may otherwise be hassling you in the next year or so.

                        If the debts are split between the two of you, there may be options such as one person going bankrupt and the other not, or one person going for a DRO and the other bankrupt.

                        I suggest you do some research on DROs: http://debtcamel.co.uk/debt-options/...relief-orders/ and if either of you has debts over 20k on bankruptcy http://debtcamel.co.uk/debt-options/...to-bankruptcy/. Then talk to National Debtline who could confirm which of your debts would be wiped out (probably all the ones that you have mentioned), talk through the implications. they can also set up DROs.

                          If you only owe approx. £600, go to the Citizens' Advice Bureau and ask them to negotiate smaller payments, ie £1 per month (see link below), even them getting £1 per month is better than them getting nothing. I note that you have anxiety too....this could be a useful when negotiating. I would not advise Debt Relief Order in your situation, as it costs money. Bankruptcy is also out of the question in your circumstances. If I were you I would go to the Citizens Advice and with their powerful influence in your type of situation, they're a more than feasible remedy.

                            We did look into Bankruptcy a while ago, but we just can't afford the money it costs to do so :/
                            We kind of hoped that HMRC would peruse Bankruptcy to alleviate some of the stress but alas they made an arrangement of £50 for my husband and will not accept a payment from myself and are demanding payment in full :scared: yet I'm the one that's unemployed :confused2:

                            Both sets of HMRC bills are £7k+ each which is made up of penalties and late payment fees only. This happened because we did not hand in the books until recently due to not knowing how to do them ourselves, no money for an accountant and my husband trying to cope with everything on his own when I completely shut down after to loosing my granddad - Times were excruciatingly difficult and my husband struggled to keep everything on track and to keep me safe as I was suicidal - I'm a little better now and I'm trying so hard to stay positive and keep fighting so everyone's help and advise is genuinely appreciated. :tinysmile_grin_t:

                                ​Unfortunately we owe money to many creditors - Which I suspect will all start to come forward now the debts are approaching the statue barred time limit.
                                Unfortunately the nearest CAB is over 20 miles away as we rent a small property in a tiny rural village meaning, in order to use their services my husband would have to take time off work and loose a days pay in order for us to go, which is kind of counter productive as it would have a further negative impact on our finances - Hence why I am trying to battle through this myself with the help and assistance of all you kind hearted
                                people out there Thank you so much for everyone's suggestions & help so far

                                If I could go all by myself I would but unfortunately its an impossible task due to my anxiety issues - I don't leave the safety of house for weeks on end and it takes me all my courage to leave the house with my husband by my side

                                I have been wondering if it may be worth while contacting all the creditors that I can remember and offering them all a copy of our income and expenditure along with a token payment to be paid on a monthly basis but the thought of loosing more money out of the food budget is enough for us to keep putting it off.

                                hmmm not sure what to do next....
