    Hello all!

    I am a bit confused with the ''struck out'' terminology here, maybe someone can explain me.
    If a claim has been ''struck out without further order ''for the simple reason that the claimant did not comply with my CPR request , can the claimant send me a new claim for the same debt?
    If they are allowed, is there a certain time frame they can do it or I can still be chased by them for the same thing 10 years down the line? or maybe until becomes Statue barred?
    If they are not allowed, this defaulted debt should not be removed from the credit report? considering the claim has been struck out?

    Hiya

    The Claimant would have to apply for permission to bring a new claim based on the same cause of action.

    If they receive the strike out order they can, within 7 days, apply to setaside the strike out and reinstate the claim.

    The Debt will remain on the credit report until it has been on there defaulted for 6 years - this isn't attached to the court claim and comes more under the ICO rules on reporting accurately to CRA's.
