I was invited to a fact finding meeting a few days ago, where i was asked questions based on my friend being investigated for gross misconduct and they believe i was aware of that conduct.
During the session they highlighted that they had whatsapp messages from a forensic investigation that they believed provided evidence of their misconduct.
My question is, as Whatsapp is a paid for product/App and similarly to Facebook/ Snapchat, of a private nature. Does the employer have the right to access those messages?
The phone is a work phone, that is allowed some mild private use, but communication can be monitored. (it's a very broad line that does not go into specific detail).
