  • fit for use and returns

hi all, I would like some advice. I brought a rise and recline chair for my wife as she is disabled. after 6 weeks the seat began to sag on one side, we contacted the retailer and they agreed to send out a "specialist" repair technician and sent out a new seat pad. the tech arrived and at first declared the spare parts as being electrical parts and not necessary "ive seen loads of these and they always send out those electric parts" was his comment until I pointed out that what was actually in the box was a seat pad. he looked at the seat pad, a sprung interior one, and said "oh that's ok then" and started to dismantle the chair.....only to find the seat pad in the chair wasn't a sprung one at all but was in fact a foam insert....."not to worry he said I have the same foam insert in the van" and proceeded to place foam in the seat and spray glue it in place and re-assemble the chair. when he finished he agreed it was wrong as the seat was now solid on one side and slopped to one side....un usable. contacted retailer and said as it had been fixed once and was within the time limit (by now around 7 weeks) I was rejecting the chair. they agreed to have it collected.
sorry to go on but here is the point. can they deduct money from the refund as my cat has scratched it? also they asked me to box the chair up before return until I pointed out that boxed up the chair doesn't fit through a door, the original box is 3feet cubed. also the chair weighs so much that when it arrived two men could only just get it off the lorry....they want me to move it outside when the returns carrier arrives as they are not insured to come inside. I had to pay to have the chair taken upstairs to the room my wife uses. what is my position as this has been going on for weeks and they are unable to find a collection company to come into the house and collect it....I cant move it outside......they cant come in and collect because of insurance purposes and my cat will continue to scratch it if I let him in the same room....your thoughts would be greatly appreciated. chair was purchased November 2015

If the goods are faulty the supplier has to meet all costs of return.
Tell them to get their insurance extended or you will get a firm of removers (Pickfords?) to do the necessary at their cost.
If the goods have been damaged they would be able to take that into consideration when making a refund.
So take pictures of the chair before it returns in case negotiations are required.

      I thought this applied....
      The act says
“(10)No deduction may be made if the final right to reject is exercised in the first 6 months (see subsection (11)), unless—
(a)the goods consist of a motor vehicle, or
(b)the goods are of a description specified by order made by the Secretary of State by statutory instrument.”
