    Hi,

    I wonder if someone can tell me how I stand with a recent purchase. To cut a very long story short.

    Purchased a Samsung oven on 26th December 2015. I took delivery next day 27th December 2015. Cooked in it on 29th December. It took 40 mins to cook a 20 minute meal. Used it again on 29th the oven was beeping all through the cooking which took double the time again.

    Called the number on the email to find I was talking to someone in the Philippines. Had to hang up as I couldn't understand them and they couldn't understand me. Decided to go to our local Currys. They had us running backwards and forwards to our house and said we had to be in store to get a refund. Then they said we had to have an engineer out. Spent all day on 31st on the phone and at the store. They won't budge. We were told to call again yesterday New Years day, they said they would try and sort it and nothing, no call or anything.

    Bottom line I have an oven that isn't working properly and I want my money back and they won't give us our money back without and engineer coming out first.

    How do I stand?

    Thank you in advance for any help as I'm going out of my mind with frustration!

    The Consumer Rights Act 2015 is the biggest shake up in consumer rights law in a generation and seeks to simplify, strengthen and modernise UK consumer law.
    The act replaces three big pieces of consumer legislation - the Sale of Goods Act, Unfair Terms in Consumer Contracts Regulations and the Supply of Goods and Services Act.
    The Consumer Rights Act introduces:
    • 30 days to get a refund For the first time a specific timeframe has been created in which you can reject a faulty item and get a full refund - now 30 days
    • A 'tiered' remedy system In place for faulty goods, digital content and services, this means your rights to a refund are now more clearly set out. Whether you're entitled to a refund depends on how long you've owned the product.
    • Failed repairs After one failed attempt by the retailer to repair or replace a faulty item, you're entitled to ask for a refund or price reduction.
    • A second repair or replacement If you don't want a refund or price reduction, you have the right to request another repair or replacement at no cost to you.
    • Deductions from refunds No deduction can be made from a refund in the first six months after purchase. The only exception to this is motor vehicles, where a reasonable reduction may be made for the use you’ve had of the vehicle.
    • Digital content rights This new law gives consumers rights in relation to online digital content that is paid for, digital content supplied free with other paid for items and digital content supplied on a physical medium, such as a DVD.
    • Unfair terms in consumer contracts It will now be easier for consumers to challenge hidden fees and charges. Now the key terms of a contract, including price, may be assessed for fairness unless they’re both prominent and transparent.
    • Pre-contract information The Consumer Rights Act states that if a retailer provides pre-contract information in relation to a service and the consumer takes this information into account, the service must comply with that information.

      WIthin 30 days you are entitled to return and obtain a refund. Outside of 30 days they get a chance to repair.

      You are inside 30 days.

        You should know

        • You have a 30-day time period to return faulty goods and receive a full refund
        • If you decide that you no longer want an item that you bought from a high-street retailer, you are not automatically entitled to a refund
        • Even if the product is covered by a manufacturer's warranty, your contract is with the retailer rather than the manufacturer; it is therefore their responsibility to resolve your issue
        • If the trader pointed out a defect at the time of the purchase, you are not entitled to a refund
        • If you paid by credit card and the amount was more than £100 and less than £30,000, the credit card company may be partly responsible for compensating you

        Quote that and don't let them fob you off you should email customer services or if you can complaints dept.

            (3)The time limit for exercising the short-term right to reject is the end of 30 days beginning with the first day after these have all happened—

            (a)ownership or (in the case of a contract for the hire of goods, a hire-purchase agreement or a conditional sales contract) possession of the goods has been transferred to the consumer,

            (b)the goods have been delivered, and

            (c)where the contract requires the trader to install the goods or take other action to enable the consumer to use them, the trader has notified the consumer that the action has been taken.


            Was the cooker installed by Currys btw ? as that might affect things.

              Consumer Rights Act 2015 applies.
              As the goods are unfit for purpose and not satisfactory (sec 9 &10)
              you have the right to reject the goods (sec 20)
              You have the right to repair or replacement (sec 23)

              Time limit to reject is 30 days from delivery

              Hand deliver to local store a letter setting out your rights.
              Tell them where and when they may collect faulty appliance.
              Insist on refund (if that is what you want) and tell them they have a maximum of 14 days in which to make it (sec 20 (15))

                We paid on debit card. We asked if we put it in our car and took it up there could we get the money back, they said no not until the engineer has been out.

                  They didn't install it but it only needed a plug on, it didn't need hardwiring.

                      The Consumer Rights Act makes it an implied term of the contract that goods be as described, fit for purpose and of satisfactory quality.

                      As you are in breach of contract I am rejecting the [item] and request that you refund the sum paid to you of [price].

                      I also require you to confirm whether you will arrange for the [item] to be collected or will reimburse me for the cost of returning it.

                      If I do not receive your satisfactory proposals for settlement of my claim within seven days of the date of this letter, I intend to issue a claim against you in the county court without further reference to you.

                        I am just on hold to their call centre in this country. Decided not to select any options.Looks like I might be onto a winner here. The guy has said straight away "I guess you want a refund"Let's see if he follows through.

                              He's gone away to call Samsung. I've told him I'm not having an engineer I'm entitled to a refund. I will get them to back it up with an email. Didn't see the post until I'd come off the phone.
