    Sorry to drag up an old thread but now in a similar position with a very large amount paid into my bank account. From the above ombudsman response it would suggest the amount would need to be repaid over a reasonable period of time at zero interest. Restitution however would require the loan paid back with simple interest at 2% per month. Anybody care to explain the difference apart from being stuffed by the english legal system.

      The ombudsman works on the basis of what appears fair & reasonable to them, not what is necessarily legally correct.
      Hence if you, the individual, disagree with the ombudsman you can continue and take the matter to court.

      Would you care to give more details of this error?

        Just won my court case against LMC with Judge finding that LMC had not signed agreement and by a clause in the agreement this means the contract is unenforceable. This also means I get title back on my property Great news you would think but no the Judge now has total power in Restitution to decide how much Unjust enrichment I have received since the 30k was paid into my bank account in Nov 2007. That figure comes to approx 94k to which you can add LMC legal costs and my own legal costs.
        Obviously going to appeal but it just stinks especially when you realise that LMC failed to send any statements out so had the contract been enforced they would be entitled to zero interest and I would have been looking forward to a 19k plus interest refund plus the return of my court costs.
