  • Bank error on Pay Upon Death Account

    My grandmother set up a pay upon death (PUD) account for her four grandchildren at a bank where she kept other accounts as well. Upon her death the bank issued payments to the four grandkids. She had a will and the remaining assets went to probate court. The beneficiary was her daughter. When the bank was contacted during the probate process, it was discovered that the bank had paid the four grandchildren the entire balance of the pay upon death account plus the balance of all the other accounts (not part of the pay upon death account). After a runaround for months the bank says that there is no money because it was paid to the PUD beneficiaries. This has created multiple family issues because the beneficiary (the daughter) is trying to recoup the money. What legal recourse she has against the bank that made the mistake to pay all the money in the multiple accounts to the PUD beneficiaries? Is the bank liable for their mistake and should pay the beneficiary? The bank is in Tampa Florida.

    Sorry to hear about the family problems but not sure you will obtain much advice that will be of use to you from this site which is UK based.

    On this side of the pond imo the administrator would proceed against he bank , which had acted outside of its instructions.
