We are helping someone with the paperwork for PIP.
The gentleman is missing 3/4 of his leg and needs some help with living.
We helped him filling out the form and he went to the assessment.
And after that he received a paper that he does not qualify.
Of course we made a mandatory reconsideration, but although we can
see it is received (tracking shows on time and on the correct address) they
have sent a letter that they did not receive anything.
We were advised to contact the Tribunal after receiving a letter that he did not send anything.
Now he received the following:
"A perusal of the file indicates an initial decision on Personal Independence Payment based on the
qualifying daily living criteria. Mr ..... appears to have appealed direct to the Tribunal before
mandatory reconsideration occurred. This decision appears to have been revised on ../../2015 on
mandatory reconsideration to the effect that benefit was refused on past presence grounds.
A mandatory reconsideration notice was issued to ta=hat effect. The respondent states that no
appeal has been entered against the revised decision."
"As a mandatory reconsideration has been issued (though the Tribunal has no copy as yet)
it appears the Tribunal has jurisdiction. There is no requirement for a second mandatory
reconsideration if the first decision is revised on MR."
"I direct the respondent to lodge within 28 days a full appeal response dealing with both
the original and the revised decisions."
Can someone help us out what would be now the best to do?
