Hi, I took a mortgage out with SPML in October 2007. The mortgage was for £122k and the property cost £166k.
Since 2011 as a family we have struggled with some awful situations beyond our control which have impacted on our financial situation. It would take too long to go into detail but in short, my daughter was raped age 14. She then went on to attempt to take her life several times. Aged 16 she was diagnosed with several mental health disorders. I became in essence her carer. At 16 she was allowed to sign herself into local authority care despite being under the influence of drugs and being of questionable responsibility. I then fought a legal battle to get my daughter back, completely in vain as under local authority care she went on to get a criminal record, to be addicted to heroin and be involved with a convicted paedophile who beat her and sold her for sex.
In 2013, it transpired that the same person who had raped and abused me for many years historically had also raped my 7 year old cousin. In the past two years I have struggled terribly. It's taken two years to get my abuser to court all of which has taken its toll as you can imagine. The result of which I have not been able to work and consequently have accrued arrears to the sum of £3,758.
I had an agreement in place to pay £600 a month which is £80 on top of my contractual payment. As I started university in September and am still awaiting student finance and an NHS bursary, both of which Acenden are aware of, I have struggled to make payments in the last two months. The last payment I made was £200 as an interim payment for November and that went through on 10th November.
the last phone call I had I was told if I could pay the £600 in the next week despite solicitors having been instructed, I would be able to reinstate my agreement. Two days later I get a letter saying they have refused my offer and repossession proceedings will begin.
today in the post I have received the witness statement and exhibits and I am due in court on Wednesday 2nd December.
i have no experience with this and I don't know what to do. I'm desperate for help and advice as I just cannot cope.
acenden have hounded me for two years and made my life he'll. they have been made aware of everything we have gone through yet send out their nasty threatening letters, continuing to add extortionate charges.
how is this fair? My house is worth in excess of £185,000 and my outstanding mortgage as of November 23rd is £113,000. I also have evidence that I am owed £2400 from student finance which is due any day. Again they are aware of this yet it means nothing.
can someone please please help me??
