    Hello
    My ex husband owes about £45k in unpaid maintenance made by consent order. I don't know where he lives but don't think it is in this country. However he has an army pension and another which I did not claim against when we divorced.
    Am I able to go back to court and ask them to give me the value of what he owes from his pension?

    It depends on the terms of the consent order. It wouldn't be a claim on his pension though, it would be enforcing the terms of the consent order - and his income happens to be his pension. Do you still have a copy ?

      Yes I do have a copy of the consent order and the variation of the order. Over the years his paid very little to what he was required to pay. His not yet collecting his pension but know they have a value. I am unable to trace him so am unable to ask the court to chase him. He had spent a lot of time abroad evading his duties as a father. The maintenance order was for what he had to pay for his children. I have already enforced it years ago when he came back to this country but he moves around quiet a bit.
      So my thoughts were to claim the money by taking part of his pension if possible as I've not been able to save as I've been having to use all my wages over the years to pay for our children and I thought this might be a way of getting what he owes and draw alone under it
