Soon to be homeless (not anymore! SORTED !!)

I am a 70 year old severely disabled man and 6 years ago I foolishly signed over my home of 30 years to Blemain as guarantee a massive loan for my daughter to refurbish 4 flats. Although she still owns those 4 flats she has just informed me that she can no longer continue paying the loan. I know how Blemain operate and know I will lose my home in approx 10 weeks. The thought of being homeless in winter in my condition i find quite terrifying and would appreciate any advice.
I have already lost my only family due to this and now my home too will have to go.

With you G on this..........So Blemain agreed to accept you offering your home as guarantor for your daughters loan.................I think the Court will order your daughter to sell the Flats...... and in this event you will be guarantor only for the remaining balance as guarantor ...did you have legal advice before you signed as guarantor..........did Blemain insist on you taking legal advice....because of your age at the time?....if not I think you could defend the possession and claim by Blemain on your home under section 140 of the CCA..............I might be talking Bulls**t as usual but worth checking on.

So you put up your own home as guarantee instead of one of the four properties she owns, she decides to stop making payments and also refuses to talk to you. What sort of human being is she?

Thanks Sparks but I did take and sign for legal advice and Blemain have me tied up like a chicken mate. I was foolish enough to believe my daughter when she said it would only be for six months duration. I am now more concerned with finding a bed for the winter as I do not know how things work except the council will not even talk to me until the eviction takes place. I have found a place that will store my furniture but I cannot walk or lift even small stuff.

It is my understanding that if you take legal advice on an issue such as this , the lender should ask for a copy of that advice to keep for their records.

Sounds like Blemain (New name now "Together") knew that the figures did'nt stack up but lent anyway with an eye on your property and the flats, its called "set up to fail". As for your daughter it maybe that she is going through the same misery and hell as you, and they have the flats tied up so she can't sell them. I financially lost everything after getting involved with this company but i still have my family. You may find she is to distraught to talk to you. you need each other at a time like this, stop blaming her, i know its hard and stressful, i really do. but money is'nt everything. Blemain is the real heartless monster not your daughter go and see her and believe me she will not want to see you because she is riddled with guilt, not because she does'nt love you, but because she knows she has harmed you, she will be feeling a fool a failure and will not know how to handle it. Go and see her and forgive her however hard it is. Do it! Lifes to short

Thank you for your view suffering but I can assure you the situation is very different to that you have put forward. Blemain have no hold over the flats and I have spent 6 years begging her to sell them to repay Blemain. She has used the Guilotine of Blemain hanging over my neck to coerce, blackmail and threaten me. I even lent her and her partner my last penny (my funeral fund) 6 years ago and it has never been repaid. I spoilt her for 40 years givng her everything she asked for but failed to teach her to live withing her means. I am now paying the price. In addition to the 4 flats her and her partner own another cottage vallued at £230k everything they own is in her partners name. I have only myself to blame and will of course pay the price.

I should add, this looks like another classic Blemain set up to fail stitch-up! They would have seen she could'nt afford the loan due to the figures not working,ie empty flats during renovation, they get around this by saying they will incorporate 6 months payments telling her this, that and the other will happen and we will do that and then we will help you reduced interest etc etc etc but in reality they know exactly what the out come will be pretending to help as they watch the equity drain away. Note how they don't go for repossession whilst there is plenty of equity left. It is not simply your daughters fault she was stitched up that's what they do. people are aware of this now and so they have just changed their name to try deceive people when the Google search them

I feel for you Gallahad, there is nothing worse than family doing each other bad whether intentionally or not. Who pays the loan and from who's account is the payment from? It might be a long shot but there might be some arguments about whether you have any rights to the flats especially if you have never serviced the loan. It might be nothing but if there is a paper trail to how the monies were used and who has been paying it might be worth getting some advice on whether you could force a sale.

G, If the worst comes to the worst ...you are welcome to come and stay with us ....we have plenty of room.................you know my situation .....so providing you know what you would be coming to .........you are welcome mate till things get sorted.

I assure you I have had good legal advice and left no stone unturned enough to know that any action I take would stand little chance and cost more than i can afford. Even if it did succeed would cause much long term damage to my grandchildrens futures. This is why I am more concerned with how to get a roof over my head than a legal battle. My disability is severe and I have never been in this situation before and need to learn how the system works.
