Please help
I Know a person who has just been served papers by anglian he suffers from MS and is a really bad state because of this matter. he was sold a 3 x 3.5 flat roof conservatory ( why flat roof I do not know) at a cost of £13500 which I believe to be an exhorbitant price, he was conned into applying for credit which would have meannt a total cost of 27300.00 even though the interest rate was 18% APR. the item was supposed to have been fitted by May 20014 but nothing has been done, they say that he telephoned to cancel on 9/12/2014 ( I would as well if the contract had not been completed) and they have only just issued papers August 2015 with no communications inbetween.
He has a doctors letter which states his mental ability has been deterating for the past 2 years. can he get legal aid (representation) under the mental health act 2005 also he is on benefits. ther is only 5 days left to submit the defence all help would be appreciated.

I would start a new thread if you can. Why are they stating breach of contract if he cancelled after the date they were supposed to have completed - surely they breached the contract? Does he have all the paperwork?

Sorry not that well up on forums and posting topics is there a guide?

They are taking advantage as there are many mistakes in the paperwork.

a variation of contract not signed by the purchaser but by Anglian rep: however their T&C's state that it must be accepted within 14 days otherwise they will cancel the contract. yet they did not and therefore one would assume that they would
continue, planning permission was granted and they sent a letter to that fact and work would start 21st April 2014, and that a payment was due according to the schedule of payments, in this case the only entry was payment on completion.
As no works have been carried out surely this must be a breach on there side.

I thank you for the assistance, however it seems that the persons daughter has now decided to get involved and will not release the papers to me, she believes a 1/2 consult with a solicitor will give her enough to present a defence.

If I get further information that may be of help to others I will post it.
