  • CCJ judgement in default - claimant agrees consent; solicitors not giving correct inf

    Hello all at LB,

I could do with some help.
I was finishing a masters degree at oxford brookes and deffered for 2 years.
In the meantime they requested final payment of payment plan be made but these were sent to university email which I wasn't checking.

Then in February I moved house, and didn't inform them - stupid I know.
I recently (2 weeks ago) was forwarded my post from my old landlord with a judgement for claimant in default for the amount plus court fees and I presume interest.

I have contacted the university to explain, and the person in the finance office agreed to my request for consent to set aside if i paid in full.

He then contacted their solicitors and they said that once payment was received they would tell the courts.
I have explained that this is not what I am asking, but that I need to do this through a consent form in order to have the judgement removed.

Anyway following several similar email responses it's clear that he doesnt have the legal knowledge to understand the difference, and that the solicitors acting on his behalf are not telling them about the process of consent order.

Obviously I want the CCJ to be removed, and they want payment in full. Any advice on how i should proceed bearing in mind that the university is happpy to give consent but they seem to be being inadequately advised as to how to proceed further.

    Best wishes,

    FF
