Hi, I'm new here. I just found your forum after finding out I have a recently registered CCJ and hope I can get some advice on what to do now.
Back in 2004, I had an outstanding 'revolving' personal loan with the internet bank Cahoot.com (now Santander Bank). At this time I was also going through a divorce which cleaned-out my savings and left me penniless.
My situation left me unable to make payments on the loan and I closed my bank account that had been funding my monthly loan payments. I understood that Cahoot would have defaulted the loan account shortly after they stopped receiving my payments.
When I contacted Santander in July 2011, I understood this 'defaulted' loan should already have been removed from my credit file, but no, wait for this...........Santander informed me that they had been receiving the monthly 'minimum repayment' for this loan since 2004. Not from me they hadn't!!
I informed them I did not make any repayments since 2004, but they insisted the minimum payment had been received every month. They could not tell me where the payments had originated from.
These minimum 'ghost' monthly payments I knew nothing about for 7 years had allowed them to add £10,000+ interest on top of the loan I had originally taken out. Still, they could not explain or tell me from whom or where these payments had originated.
They placed a 'special instruction default date' on my Credit File, starting July 2011. I asked them to supply me with details of the mystery loan payments they had received. They said they did not have that information.
I asked them to default the loan from when I stopped paying in 2004. They refused to do that, insisting I had been paying "every month" and now they would 'default' the loan on my Credit File with effect from July 2011.
Indeed, they left this 'default' running on my Credit File from July 2011 until March 2015. The monthly 'ghost' payments mysteriously stopped being applied to loan from July 2011 and they still continued to add interest.
I now have a very recent County Court Judgement for an unbelievable sum of money, due wholly to them manipulating and abusing their duties and responsibilities as a lender.
Do I have any legal redress?
Please help.
