    PLEASE I NEED ADVISE - STARING TO PANICK NOW !!!


    Hi can anyone help me here I received a court claim from BW Legal/Lowell dated 15 January 2015. Lowell claim I owe this debt and have sent me numerous letters. I have not paid anything to Lowell certainly in the last five years. I have checked four main credit scores (Experian, Equifax, Noodle and Callcredit ) and nothing appears on any of them. We originally had a loan with Capital Bank and a credit card IE the preference account was part of the loan. The account was held against our property and when we sold in 2009 the loan was settled in full by our solicitor who oversaw the sale of the property. We have asked Lowell to provide us with more information but they just send us a copy of the agreement from 1998. I have replied to the court to say I am defending. I sent a letter (copied from this site) asking B W for full disclosure this was signed for by them on the 23 January I also sent a letter to Lowell and included a £1.00 postal order. To date I have received nothing from Lowell and two letters dated 16 & 17 January from BW Legal asking me to call them to arrange a payment plan. What is our next step? Please help.

    So you believe the debt being claimed was paid off in 2009? Have you been in touch with the lender at all or got any paperwork since 2009 about the debt ? Any papers about the house sale which might have mention of the loan/cc in ?

      Thanks for getting back to me so quickly on a Sunday morning !
      All I have from the solicitor handling the sale is a list of settled accounts after the sale of the house. They agreed a settlement figure of £14,000.00 with Bank of Scotland. I haven't been in touch with RBS but have sent the standard letter to Lowell (including £1.00) postal order this letter was signed for on 22 January. I have also sent the standard letter to BW Legal this was signed for on 23rd January I have heard nothing from either party re my request.
      I did receive two letters from BW one dated the 16th January and one dated 19th January asking me to contact them to make an arrangement to pay as they may enter a CCJ against me after 4th February.
      The claim form is dated 15th January I received it on Saturday 17th I have acknowledged the claim with the court and said I wish to defend.
      Any help you can give me would be much appreciated.

        Just for more info I have checked the four top credit scores and this does not appear on any there's just no mention at all.
        Am I right in thinking that as Lowell has not responded in the time scale and BW Legal hasn't complied with my request or confirmed in writing their agreement to an extension as allowed under CPR 15.5 that I should just go ahead with my defence stating this ?

          'They agreed a settlement figure of £14,000.00 with Bank of Scotland.'' Is that the same debt ? ( getting a bit confused with mentions of RBS, BOS and Capital Bank).

          And how much is the claim for? What was the original debt? How much and who with ?

          Have you informed Lowell/BW that the debt was settled in 2009 ? If not we should do that. And also write to (or telephone would be quicker) BoS and ask them for evidence of the settlement of the debt.
