  • Hi Everyone

    Hi I hope you can help me out.
    I got a pcn from my council I wrote to them saying I couldn't view the cctv footage and never got a response.
    Then I got a letter saying it had gone to court & I called up and was asked to fill in a out of time form, I had some family issues come up and forgot to send the form off.
    The bailiff came to my address and left a control of goods letter on a window sill downstairs I live in a block of flats with 2 floors and I live on the 1st floor.
    I then didn't receive this letter til days later and they had added on £310 worth of charges taking it up to £512 & this was the 1st contact they had made with me.
    I called the bailiff and explained to them that someone left the letter downstairs and that someone had opened it and now has information about me and that someone was lurking inside the block late at night (2 of the flats have been broken into in the last 6month) and I reckon it was this guy who opened my letter.
    I have 2 young daughter's and after explaining the danger the bailiff has now put me and my kids in she hung up on me I live in a high crime area they weren't bothered.
    I really don't know what to do and as it's the weekend I can't get in touch with my council and that is if they will help me.
    Could really do with some advice please.

    The bailiff hasn't given you proper notice if the control of goods letter was not delivered to you properly. The National Standards for Enforcement Agents require that “Enforcement agents should, so far as it is practical, avoid disclosing the purpose of their visit to anyone other than the debtor. Where the debtor is not seen, the relevant documents must be left at the address in a sealed envelope addressed to the debtor. Leaving confidential correspondence like this on a downstairs window sill surely has to warrant a formal complaint!

    Did you receive any letters from the bailiffs before this?? You should have had at least one prior to the bailiff visit!

    Which bailiff firm is it?? Could you post up a copy of any documents you have been sent (with identifying bits removed) ??

      Hi Katie,
      No I never received anything from them before that letter.
      It's Newlyn when I spoke to them about the bailiff leaving the letter downstairs she said they can leave the letter downstairs if there is a foyer area which I said to her there isn't and she said they don't have to come upstairs to my flat they only have to leave it inside the block.

        thanks for answering .,.. I do think a complaint is in order here, they have breached Data Protection by leaving this letter where they did :tinysmile_hmm_t2:

            They are liars, cheats and collaborate with each other, to twist the truth.

                            They are employed by the council to recover this debt aren't they?? Which council is it?? (I can do some digging around for things you can use there too LOL)
