  • old unpaid debt

hi to one and all...... my wife is being chased by a credit company called marlin financial services. we have some old debts that are 10 to 13 years old. we are getting a little straighter as we have avoided credit in recent times. we know we need to pay these but as a large portion of the balance is made up of charges, we want to maybe pay a lesser amount in full settlement. what is oppinion on making offers to these people. any advice will be much appreciated

Have either of you acknowledged or made any payments towards these aged debts in the last 6 years?
Life is a journey on which we all travel, sometimes together, but never alone.

If you haven't made any payments or acknowledged these debts in writing in at least 6 years, you may not need to pay them at all! :thumb: Under the Limitation Act 1980, when no payments or acknowledgments are made for a period of 6 years, the debts become statute barred, meaning they cannot be recovered through the courts, and there certainly is no reason why you'd want to pay a SBd debt. :nono:

This period applies to most unsecured debts. It does not apply if they have obtained judgment (a CCJ) against you. See this factsheet for full details: http://www.nationaldebtline.co.uk/en...limitation_act
