  • hi all, another new member!

    hi all
ive arrived at these forums via searching for advice and letter templates, due to being not paid properly for the second time this year.
Im a sole trader landscape gardener mainly working on a sub comtract basis for larger limited companys.
I will be honest and say ive had a good run over the years, but now the last 2 companys i have worked for have turned sour. The first one for 3k
i've given up on,now this one trying to shave £thousand off bill(if they ever pay it).
Will be posting a brief of the situation and any help will be greatly appreciated.
I was told by a local solicitor to "just accept " what they offer as it will cost hundreds if not thousands to pursue...
I just dont have the funds to go down a legal route, do i just roll over? again??
BTW not shure where in forums to post details of my case

    regards

Hi and welcome to Legal Beagles. You seem to be talking about an employment issue, so I'd suggest posting here:

Sounds as though you need to go through the small claims court, as long as the money owed is less than 10,000. It is not complicated but you first need to tell them that you will be taking action through the courts so that they can think about paying. Then go to https://www.moneyclaim.gov.uk/web/mcol/welcome and follow the instructions.

I've used it several times when customers have been "reluctant" to pay. Works well. Even got one debtor to send the secretary round with cash after they had bounced 2 cheques on me. Just the service of the form from the court is usually sufficient to get the debt settled.

Others will no doubt offer additional advice
